The Federal Justice of Río Gallegos has issued a precautionary measure that suspends the application of modifications to the Glacier Law in the province of Santa Cruz. The decision arises in the context of an environmental collective protection promoted by authorities in El Calafate.
Consequently, the ruling orders the National State to refrain from executing actions that could affect glaciers or the periglacial environment. In this way, it seeks to prevent irreversible impacts while the substantive issue is analyzed.
Furthermore, the resolution highlights the importance of these ecosystems as strategic reserves of fresh water. Therefore, their preservation acquires a central value in the face of the advancement of activities with potential environmental impact.

The scope of the judicial measure in Santa Cruz
The precautionary measure applies throughout the entire provincial territory and prevents decisions based on the reform of the Law No. 26,639. In particular, it aims to halt initiatives that would enable currently restricted activities.
On the other hand, the judicial presentation warns of a possible reduction of protected areas. In this sense, it is noted that this would imply a regression in the current environmental standards.
Additionally, the proposal questions the transfer of powers to the provinces in regulatory matters. According to the arguments presented, this could weaken the minimum budget system established by the National Constitution.
Environmental principles and urgency of protection
The ruling revisits key principles of environmental law, such as precautionary, progressivity, and non-regression. Consequently, it prioritizes preventing damage rather than repairing it, especially in vulnerable ecosystems.
In turn, the judge considered that a delay in the final ruling could render the sought protection ineffective. Therefore, it was decided to act preventively against possible risks.
In this context, the measure seeks to ensure that current conditions are not altered until a final resolution is issued. Thus, it preserves the environmental balance in a highly sensitive region.

Glaciers and periglacial environment: a balance at stake
Glaciers play an essential role in water and climate regulation. Indeed, they function as reserves of fresh water and support multiple associated ecosystems.
Similarly, the periglacial environment acts as a key transition zone for ice dynamics. Therefore, any alteration can generate chain impacts on the environment.
In parallel, various economic activities depend directly or indirectly on these systems. However, their development requires strict regulations to prevent environmental degradation.
What did the Glacier Law seek?
Law No. 26,639 was enacted with the aim of establishing minimum budgets for the protection of glaciers and the periglacial environment. In this framework, it defined these spaces as strategic assets.
Likewise, the regulation prohibited activities that could affect their stability, such as mining exploration or the release of pollutants. In this way, conservation was prioritized over intensive exploitation.
Additionally, the law promoted the creation of national glacier inventories. This allowed for the generation of key information for their monitoring and sustainable management.
Finally, its spirit focused on ensuring access to water and protecting essential ecosystems against climate change. Therefore, any modification generates debate around the balance between development and conservation.
