## What the law says

The “Superfund Climate Change Law” will require these companies to make payments for damages caused between 2000 and 2018 **over the next 25 years**. This is based on their historical greenhouse gas emissions.

The New York State Government, **one of the most Democratic areas in the country**, believes that the environmental fund is an essential part of its energy transition plan. Therefore, it is prepared to fight **against the new legal offensive**.

## Lawsuit from the most conservative states

The Attorney General of **West Virginia**, **JB McCuskey**, leads the coalition of 22 states against this climate fund.

The lawsuit argues that New York’s law is “an **example of the resulting chaos** when states exceed their limits.” In addition, it highlights that **coal, oil, and natural gas** were crucial at one point for that state.

“They helped keep the lights on in Albany, manufacture the steel that held up the **iconic skyscrapers of New York City**, and power the industry that keeps the New York ports running,” the lawsuit states.

The other represented states are **Alabama, Arkansas, Georgia, Idaho, Iowa, Kansas, Kentucky, Louisiana, Mississippi, Missouri, Montana, Nebraska, North Dakota, Ohio, Oklahoma, South Carolina, South Dakota, Tennessee, Texas, Utah, and Wyoming**.

The lawsuit accuses the State of New York of trying to force energy producers and consumers from other states “to subsidize certain infrastructure projects based in New York,” like a new sewage system.

This triggered the United States to take strong decisions regarding the departure from the climate agenda.

In his inaugural speech, Trump stated that he would declare a “national energy emergency,” even though the United States is **now producing more oil** than any other country at any other time.

In line with this, he also confirmed that the country would leave the Paris Agreement, the most crucial current climate agreement.
