Three business owners in the Autonomous City of Buenos Aires will face a trial as they are accused of selling contaminated water unfit for human consumption in 2023.

According to federal prosecutor Alejandra Mángano, the products contained bacteria such as coliforms, Escherichia Coli, and Pseudomonas Aeruginosa, posing a concrete danger to public health.

The accused in the sale of contaminated water

  • Gustavo Carmelo Russo: Representative of the company Soda la Generosa SRL.
  • Romina Aguirre: Head of Blue 480 SRL, known as Reino del Hielo.
  • Carlos Alberto Bonavoglia: Manager of Carlos Alberto Bonavoglia S.R.L.

The three are accused of violating article 201 of the Penal Code, which establishes penalties ranging from 3 to 10 years in prison for commercializing foods dangerous to health, concealing their harmful nature.

The investigation

The case began after a complaint from a civil association that warned about the commercialization of contaminated bottled waters. In December 2023, the National Court of Criminal and Correctional Federal 6 ordered raids on the implicated companies, allowing the extraction of water samples that were later analyzed by the General Directorate of Hygiene and Food Safety of the City of Buenos Aires.

Chemical and microbiological studies confirmed that the water did not meet the requirements of the Argentine Food Code, due to the presence of harmful bacteria.

Responsibility and consequences

The prosecutor emphasized that the company owners acted with full knowledge of the risk posed by the commercialization of their products. Their history in the industry showed a willingness to engage in illicit maneuvers that endangered human consumption.

This case highlights the importance of ensuring food safety and strict regulation of products intended for human consumption to prevent risks to public health.
