A pilot had to buy park ranger shoes after an unauthorized flyover in a National Park

An unprecedented event in environmental justice in Argentina culminated in a creative and restorative resolution for the illegal overflight in the Quebrada del Condorito National Park.

A man who was detected performing an illegal overflight in a protected area had to comply with a probation that consisted of purchasing professional footwear for the park rangers of the affected area.

The origin of the infraction

The incident occurred when a private aircraft was identified flying at low altitude over the territory of a National Park, an activity that is strictly regulated to prevent noise pollution and stress on the wildlife.

Environmental protection laws prohibit these overflights without specific permits, as the vibrations and noise from the engines can disrupt the reproduction cycles and behavior of endangered species.

Following the complaint made by the National Parks Administration (APN), a criminal case was initiated against the pilot for violating the conservation regulations.

An alternative judicial outcome

Instead of proceeding to a traditional trial, the defense and prosecution agreed on a suspension of the trial (known as probation).

The justice system determined that the damage caused to the biodiversity and the natural environment should be compensated in a way that directly benefits those who guard the natural heritage.

The ruling established that the offender had to purchase and deliver a batch of safety shoes and high-quality technical boots.

These items are essential for the land patrols that agents conduct daily in areas of difficult access, where equipment wear is constant due to the weather conditions and geography of the protected area.

This resolution not only ensures that the State does not have to bear the cost of the footwear, but also sets a precedent on civil responsibility and environmental accountability.

The park rangers who benefited highlighted that, due to the current limited budgets, this type of mandatory donations helps maintain the operability of controls against poaching and illegal logging.

The National Parks Administration emphasized that law enforcement is not intended to be merely revenue-generating, but educational.

The pilot, in addition to purchasing the supplies, had to acknowledge his mistake and commit to respecting the management plans of the protected areas in the future.
