Córdoba sanctions environmental offenders by law and unifies the sanctioning regime
The Legislature of Córdoba approved a law against environmental offenders, which unifies the sanctioning regime and the administrative procedure for infractions in water, environmental, and natural resources matters. This measure aims to organize the extensive and diverse regulatory framework existing in the province. The approval took place during the 22nd ordinary session of the 146th legislative period, chaired by the Vice Governor and President of the body, Myrian Prunotto.
Among the main novelties, the new law modifies the functions of the Environmental Police and creates the Environmental Administrative Tribunal, a specific body responsible for judging and sanctioning environmental offenders. In this way, the Environmental Police will be exclusively dedicated to inspection and control, separating their roles and streamlining processes.
The law introduces a fixed unit of fine measured in liters of fuel, which brings clarity and updating to the sanctioning system. Additionally, it allows sanctioning those offenders who do not comply with environmental remediation after causing damage, and establishes the Environmental Offenders Registry to identify those who do not meet their legal obligations.
Legislator María Victoria Busso, spokesperson for the project, stated: “The goal is not punishment but to promote a change in behavior among citizens; the sanctions aim to raise environmental awareness, protect our resources, and remediate the environmental damage caused”.
Busso also highlighted that the creation of the Environmental Administrative Tribunal seeks to reduce the resolution times of cases, eliminating previous bottlenecks and allowing the State to act more efficiently against infractions. “This law represents a technical, legal, and operational advancement in terms of environmental management, and is innovative on a regional level,” she concluded.
