Pollution of the Riachuelo: ACUMAR tightens sanctions for environmental violations in the Basin.

The Cuenca Matanza Riachuelo Authority (ACUMAR) implemented changes in its system of inspection, control, and sanctions in the framework of the Riachuelo pollution.

This was done through Resolution 203/2025, published this Monday in the Official Gazette. The measure establishes harsher fines and a simplification of administrative processes. The aim is to strengthen the effectiveness of environmental control in one of the most critical areas of the country.

New infractions and aggravated penalties

The agency added as offenses the submission of false data or altered documentation and the failure to register. These infractions can be directly recorded by inspectors in inspection reports.

In cases where false information is proven, a deadline for correction will be imposed, with harsher penalties if the required correction is not complied with.

Another significant change is the increase in penalties for establishments that do not build or adapt the Sample and Flow Measurement Chamber.

This system is key to identifying a single discharge point, and its absence constitutes, according to ACUMAR, a serious omission that has been hindering environmental control in the basin for more than 17 years.

Fines, deadlines, and benefits for early payment

The resolution also updates the amounts of fines related to the failure to submit progress reports, adaptation plans, technical information, and environmental documentation.

In addition, specific penalties are reintroduced for those who partially or totally fail to comply with those plans.

Among the changes are new payment methods: benefits for early settlement, the possibility of paying in installments, and a clearer framework regarding deadlines and surcharges.

Simpler procedures and greater legal certainty

The new regime eliminates intermediate stages in sanctioning procedures but maintains the right to defense.

It also incorporates regulations that were not previously considered, such as recurrence criteria, prescription periods, and the interest calculation in debt certificates.

With these changes, the organization seeks to strengthen environmental control and make progress in the recovery of the Cuenca Matanza Riachuelo.
