Historic ruling: six dogs declared sentient beings for the first time in Mendoza due to animal abuse

The Justice has issued an unprecedented ruling of effective compliance, also granting the definitive custody of six dogs to an NGO. This judicial process establishes a key precedent for the province of Mendoza.

The Judicial Power of Mendoza issued a resolution considered historic in a case for animal cruelty. For the first time, an effective prison sentence was imposed related to dogs, basing the ruling on the recognition of them as “sentient beings”.

According to the communication from the Mendocino Equine Protection Association (PEMPA) through its digital platforms, the protagonists of this judicial measure are six animals —Yuma, Barbucha, Bigotes, Tornadito, Indio, and Carmela— who suffered critical scenarios of abuse.

The sentence, dictated by Judge Gabriel Bragagnolo of the Collegiate Criminal Court No. 2, not only set an effective penalty of two months and one day (which implied the detention of the aggressor), but also ordered that the definitive custody of the dogs remain under the responsibility of the NGO, ensuring their permanent well-being.

One of the most significant pillars of this ruling is that it explicitly defines animals as sentient beings. This approach, promoted by the plaintiff, is beginning to establish itself as a legal precedent of weight in the region.

This advancement constitutes a fundamental step in the legal interpretation regarding the legal status of animals, a debate that has gained strength in recent years in Mendoza with notable progress.

From PEMPA, the entity that intervened as plaintiff, they highlighted their support for the fiscal accusation and emphasized the need to evolve towards much more robust protection regulations for non-human animals.

The organization stated that this ruling not only safeguards the direct victims of this episode but also sets a roadmap for upcoming judicial processes for animal abuse.

Finally, the association expressed its gratitude for the joint work of various organizations, including the Rural Police, the Departmental Investigative Unit (UID) of Las Heras, the Prosecutor’s Office specialized in animal abuse, and the Zoonosis area.
