United States advances in animal care policies: bans the sale of dogs and cats in pet stores

The United States has taken a new step in animal welfare care. This is the new law approved in the state of Colorado that prohibits the sale of dogs and cats in pet stores starting from January 1, 2027.

According to the office of the state governor, Jared Polis, this measure aims to modify the domestic animal market and address some issues related to animal welfare, commercial breeding practices, and overpopulation, focusing on traders, breeders, and adopters throughout the state.

The official document of the Colorado General Assembly, the HB26-1011 law, known as the “Pistol the Pomeranian Protection Act”, prevents pet stores from selling, auctioning, transferring, or leasing the ownership of dogs and cats.

On the other hand, stores will be able to operate as adoption spaces for animals coming from local shelters. This change responds to a national debate and reports on animal welfare issues and overproduction in breeding and the domestic animal trade.

What does the new law establish?

According to HB26-1011, starting from January 1, 2027, pet stores will only be able to house animals for adoption, provided they come from registered shelters or rescue organizations.

In this way, it seeks to maintain the bond between animals waiting for a home and potential adopters, without a commercial transaction involved.

The implementation and supervision of this new law will be under the responsibility of the Colorado Department of Agriculture and the animal protection organization ASPCA (American Society for the Prevention of Cruelty to Animals).

They will be responsible for monitoring the effects of the law on the market and public health, reviewing animal welfare indicators, adoption rates, and potential changes in the functioning of the informal market.

What are the benefits of this initiative?

In summary, the new Colorado Law, HB26-1011, provides the following benefits:

  • Eradication of “Puppy Mills”: Stops the commercialization of animals from mass breeding facilities operating in precarious conditions, focusing on animal protection.
  • Encourages Adoption: Requires pet stores to operate as adoption centers in collaboration with local shelters and rescue groups, increasing opportunities for homeless animals to find families.
  • Reduction of Overpopulation: By decreasing the commercial supply of pets, it relieves pressure on animal shelters, which face high euthanasia rates, helping to control the abandonment crisis.
  • Promotion of Ethical Treatment: Ensures that animals traded come from responsible sources (licensed breeders who do not sell to stores) or shelters, reducing mistreatment and intensive breeding.
  • Community Partnership: Promotes a “adopt, don’t shop” model, aligning commercial practices with the community’s animal welfare values.

The measure contemplates fines of up to $1,000 per animal for businesses that violate the regulations starting in 2027.
