Historic Ruling in Jujuy: Justice Recognizes Animals as Legal Subjects

The Fourth Chamber of the Civil and Commercial Court of Jujuy, led by Dr. Mateo, issued a ruling that could transform the legal approach to animal rights in Argentina.

In a case for moral damage initiated by a woman against three animal rights activists, the court dismissed the lawsuit and, in justifying its decision, recognized animals as subjects of rights, moving away from the traditional framework of the Civil and Commercial Code, which considers them objects.

The Cafrune Case: Between the Search and the Duty of Care

The case originated from the disappearance of Cafrune, a dog entrusted to the plaintiff. When trying to recover it, the activists discovered that the animal was no longer there. The woman claimed it had died but did not provide conclusive evidence. In response, various social media accounts launched the campaign “Where is Cafrune?”, which the plaintiff interpreted as a public shaming.

The ruling concluded that there was no defamation, but rather a legitimate action of animal search and protection, as explained by activist lawyer Dra. Dafne Rodríguez.

The most significant aspect of the ruling is the change in legal framework: animals cease to be treated as things and become subjects of rights, which implies they can be holders of legal protection.
